Des Sparkes's Essential Advice to Buyers of Property in Spain

The most common mistake made by buyers of property in Spain is to use a Spanish lawyer recommended by the estate agent or developer. This is because these Spanish lawyers cannot be independent as they have a conflict of interest due to the fact that they will be getting most of their clients either from the vendor or his agent. Therefore there is a serious risk that they will not point out defects in the property to the buyer for fear of 'biting the hand that feeds them' and losing the future recommendations from the agent or vendor. This is a serious danger to buyers as we have been contacted directly by numerous British buyers who have been advised to complete on the purchase of properties before the developer has received the official 'habitation licence' for the property from the local planning department. Obviously those lawyers were not acting in the best interests of the client but really for the developer. So it is very important for buyers to find an independent Spanish lawyer with no connections to any developers or agents to act on their behalf.

Also ensure that the Spanish lawyers you use are actually qualified Spanish lawyers (Abogados) registered as members of their local Spanish Law Societies and any English Solicitors you use in Spain hold both an English Practising Certificate and are also members of their local Spanish Law Society (in the Malaga area this is the IIustre Colegio de Abogados de Malaga). Unfortunately it is also very common for British buyers to automatically assume that the person they are dealing with is a licensed and qualified lawyer without actually checking whether this is true. They usually then only discover this when they find a legal problem with the property they have purchased, by which time it is too late and they then have to pay another Spanish lawyer to resolve the legal problem.
